TERMS AND CONDITIONS

1. Promoter

This promotional competition is conducted and administered by Vat ‘n Biki (“the Promoter”).

2. Eligibility

1. The competition is open to persons aged 18 years and older.
2. Participants must be residents of South Africa and possess a valid South African Identity Document, Passport, or other acceptable form of identification.
3. The Promoter reserves the right to verify the eligibility of any entrant.
4. Employees, agents, immediate family members, and representatives of the Promoter may be excluded from participation at the Promoter’s discretion.

3. Entry Process

1. Entry into the competition costs R200.00 (Two Hundred Rand) per entry.
2. Multiple entries are permitted. Each paid entry will constitute a separate chance to win.
3. An entry will only be considered valid once payment has been received and confirmed by the Promoter.
4. Participants must retain proof of payment until the winner has been announced and the prize awarded.

4. Competition Period and Draw Date

1. The competition shall remain open until the minimum number of ticket sales required by the Promoter has been achieved, subject to a maximum period of 12 (twelve) months from the launch date of the competition.
2. The official draw date will be determined by the Promoter based on ticket sales and competition requirements.
3. The draw date will be announced exclusively via the official Vat ‘n Biki WhatsApp Group.
4. Participants acknowledge and accept that the draw date is dependent on achieving the required minimum ticket sales and is therefore not fixed.
5. If the minimum required ticket sales are not achieved within the 12-month period, the Promoter reserves the right to:
   • Extend the competition period;
   • Amend the prize offering;
   • Conduct the draw using the entries received; or
   • Refund participants at its sole discretion, subject to applicable laws.
6. All competition updates, announcements, and notices will be communicated through the official Vat ‘n Biki WhatsApp Group.

5. Prize

1. The prize consists of one Harley-Davidson motorcycle as advertised by the Promoter.
2. The motorcycle is not a new motorcycle and is a pre-owned vehicle.
3. Images used in promotional material are for illustrative purposes only. The actual motorcycle may differ in appearance, specifications, accessories, condition, colour, mileage, or features.
4. The prize is not transferable, exchangeable, or redeemable for cash.
5. The Promoter reserves the right to substitute the prize with a similar prize of equal or greater value should circumstances require.

6. Prize Condition and Acceptance

1. The Harley-Davidson motorcycle is awarded voetstoots (“as is”).
2. No warranties, guarantees, representations, or assurances are provided regarding the motorcycle’s condition, roadworthiness, performance, mechanical reliability, mileage, or suitability for any purpose.
3. The winner accepts the motorcycle in its existing condition at the time of transfer.
4. The winner may be afforded a reasonable opportunity to inspect the motorcycle prior to transfer of ownership.
5. The Promoter shall not be responsible for any repairs, servicing, maintenance, defects, breakdowns, or future expenses associated with the motorcycle after the prize has been awarded.

7. Winner Selection and Verification

1. The winner will be selected through a random draw from all valid entries received.
2. The draw will be conducted on the official draw date as announced by the Promoter.
3. The winner will be announced via the official Vat ‘n Biki WhatsApp Group and may also be announced on social media platforms or other communication channels.
4. Before receiving the prize, the winner may be required to provide proof of identity and any documentation reasonably requested by the Promoter.

5. Should the winner:

   • Be unreachable;
   • Fail to respond within 14 (fourteen) days;
   • Fail verification requirements; or
   • Refuse acceptance of the prize;

   the Promoter reserves the right to conduct a redraw.

8. Costs and Responsibilities of the Winner

Unless otherwise stated in writing by the Promoter, the winner shall be solely responsible for:

• Vehicle licensing;
• Registration fees;
• Roadworthy certification;
• Insurance;
• Transport and collection costs;
• Fuel;
• Maintenance and repairs; and
• Any taxes, duties, levies, or costs associated with ownership and use of the motorcycle.

9. Fraud and Disqualification

1. The Promoter reserves the right to disqualify any entrant who:
   • Provides false or misleading information;
   • Engages in fraudulent conduct;
   • Attempts to manipulate the competition;
   • Breaches these Terms and Conditions.
2. The Promoter’s decision regarding disqualification shall be final.

10. Limitation of Liability

1. Participation in the competition is entirely at the participant’s own risk.
2. By entering, participants release and hold harmless the Promoter, its owners, employees, agents, sponsors, affiliates, and representatives from any claims, damages, losses, injuries, liabilities, costs, or expenses arising directly or indirectly from:
   • Participation in the competition;
   • Acceptance or use of the prize;
   • Ownership or operation of the motorcycle; or
   • Any defect, malfunction, or issue relating to the motorcycle.
3. The Promoter shall not be liable for technical failures, payment processing delays, communication errors, or events beyond its reasonable control.

11. Cancellation, Amendment, or Suspension

1. The Promoter reserves the right to amend, suspend, postpone, or cancel the competition at any time should circumstances beyond its reasonable control make it necessary to do so.
2. Any amendments or changes shall be communicated through the official Vat ‘n Biki WhatsApp Group.

12. Personal Information

1. Participants consent to the collection and processing of personal information for the administration of the competition.
2. Personal information will be handled in accordance with applicable South African privacy legislation.

13. Acceptance of Terms

1. By purchasing an entry, participants confirm that they have read, understood, and accepted these Terms and Conditions in full.
2. The Promoter’s decisions relating to the competition shall be final and binding and no correspondence will be entered into.
